This website (the “Site”) is operated by and is the property of ParkWest Executive Services, Inc, d/b/a Town Car International (“TCI”).
The following describes our Privacy and Security Policy, as amended or otherwise changed from time to time, applicable to the services available through the Site, from TCI. By visiting the Site, you are accepting the Privacy Policy described herein. You may not reproduce or distribute any part of the content of the Site for commercial purposes.
You acknowledge that the copyright, trademark rights, database rights, patent rights and all other intellectual property rights comprised in or relating to this Site and in the data it contains, including but not limited to text, graphics, audio, video or image files, content, software, data and information displayed on, or available from this site, belongs to TCI. This includes the organization and layout of the site and the underlying software that's owned by TCI or our licensors, affiliates and/or suppliers. You agree that all these materials are available for your personal use only, and you may not copy, modify, alter, publish, broadcast, distribute, sell or transfer any such materials without the written permission of TCI.
TCI operates this Site to provide efficient access to our services and facilitate e-commerce transactions with TCI; communicate corporate news; communicate information about our products and services; to provide a tool for communicating with our customers; to enable our customers to make ground transportation reservations and access their reservation receipt(s) and modify their profile information. The Site is used to communicate with our drivers, affiliates and suppliers around the world. General information on ground transportation, service overview, general company information, press releases and online registration process for TCI services are also provided through the Site.
We value your trust in us and TCI will continue to ensure your confidence in us remains high; you continue to use our services and you enthusiastically recommend TCI to others.
Protecting your privacy and the security and integrity of your information is of paramount importance to TCI. We will take all necessary steps to ensure that your information remains secure and private and is only used in relation to performance of services as requested by you, from TCI.
TCI promises never to sell, rent, barter or share with any third party, personally-identifying information collected during your use of the Site without your explicit prior permission. TCI will not provide information to any government authorities without your prior permission or the law require us to provide such information.
From time to time we may reveal general statistical information about our Site and visitors, such as number of visitors, number and type of goods and services purchased, etc., but we will never reference you by name or specific address.
TCI’s host computers and servers are located in the United States. Information collected by TCI is stored in a single, secure database, accessible only by TCI. By your use of the Site you consent to your data being transferred to and processed by TCI.
The Privacy Policy does not constitute a contract between TCI and you. By use of the Site, you acknowledge that you do not intend for the Privacy Policy to form a contract with TCI
We collect and store the names, addresses, payment information and other personally-identifying information of the customer who uses our Site to make ground transportation reservations. This information is saved in a secure environment and is kept for our records and to make it easier for you to use our services.
To serve you more efficiently and with better quality, we use "cookies" technology. Cookies are small bits of code, usually stored on a user's computer hard drive, which enable a Web site to "personalize" itself for each user. We use cookies to reduce the time it takes for you to submit reservations. No third party has access to the information we collect this way, but if you'd rather we didn't use cookies when you visit us, you can turn them off in your browser.
Voluntary Information may be collected from you in several instances when you are on the Site. When you request information to be sent to you on various products and services, or when you provide us information regarding business transactions, you will be asked to complete an online form or submit information via e-mail. The information you provide will never be used for purposes other than for the reasons it was given, without your permission.

We do not reveal your name, address, payment information or other personally-identifying information to any participating seller, manufacturer, retailer, or sponsor of TCI unless you affirmatively select a Provider and/or the Provider agrees to provide the product or service you requested.
Information we collect is used to build features that will make the services available on the Site easier to use. This includes faster reservation requests, better customer support and timely notice of new services and special offers.
Information you provide may be shared internally with other TCI departments or affiliates in order to process your request for information or services. Information is not shared outside of TCI, unless your permission has been obtained first.
Only employees who need the information to perform a specific job (for example, fulfilling your reservation or billing) are granted access to personally-identifying information.
TCI may use third party providers to support fulfillment of your reservation request or for the services you are using. If your reservation is fulfilled by one of our global affiliates, TCI may need to share some of your information with that affiliate. In such cases, please be assured that only the information required to fulfill the reservation request is shared, your payment information is never shared.
To protect your privacy and security, we will verify your identity before granting access or making changes to your personally-identifying information. If you have registered your profile on any of the services available on our Site, your e-mail address and password are required in order to access your profile information. If you forget your username and/or password retrieval of that information may only be obtained though a pre-registered e-mail address.

TCI uses Secure Socket Layer (SSL) technology to encrypt all your personal information including payment information, name and address to prevent your information from being read during transmission over the internet. Similarly, SSL technology is used to encrypt your personal information when you submit a reservation and throughout the site.
TCI reserves the right to alter, amend or change our Privacy Policy at any time. To the extent practical any changes will be communicated through our Site at least 10 days in advance of implementation. Information collected before changes are made will be secured according to the previous Privacy Policy.
In the event of a data breach, we will provide you with the notification required under federal and state law.
TCI provides the Services, the Site, its contents, and any and all other services and information provided herein on an "as is" basis. You expressly agree that your use of the Services and the Site is at your sole risk. TCI expressly disclaims warranties of every kind, express and implied, including without limitation any warranty for information, services, or non-infringement in connection with the Site and the Services and any implied warranties of merchantability and fitness for a particular purpose.
TCI does not represent or warrant that the functions of the Services or the Site will be uninterrupted or error-free, that the information supplied via the Services or on the Site will be accurate, that defects will be corrected, or that this site or the server that makes it available are free of viruses or other harmful components. In particular, if you obtain copies of receipts or other records via the Services, you should independently verify the accuracy of all information in such receipts.
Under no circumstances, including, but not limited to, negligence, shall TCI or any other parties involved in creating or maintaining the Site be liable for any special or consequential damages that result from the use of, or the inability to use, the Services or the Site, even if TCI or its authorized representative has been advised of the possibility of such damages.
Applicable law may not allow the limitation or exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you. In no event shall TCI's total liability to you for all damages, losses, and causes of action (whether in contract, tort, or otherwise) exceed fifty dollars ($50).
These disclaimers of liability apply to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, act of god/act of nature, communication line failure, theft, destruction, unauthorized access to, or alteration of the website, whether for breach of contract, tortious behavior, negligence, or under any other cause of action.
By using the Website or accessing any information herein, you agree that your use of the Website will be governed by the laws of the State of New York. You also agree that any legal or equitable claim arising from your purchase must be brought in the state courts located in Queens County, New York, or the U.S. District Court for the Southern or Eastern Districts of New York, and you consent to the exclusive jurisdiction of and venue in such courts. TCI's failure to exercise or enforce any right or provision of the Agreement will not be deemed to be a waiver of such right or provision. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in this provision, and the other provisions of these Terms remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Website or products purchased through the Website must be filed within one (1) year after such claim or cause of action arose or be forever barred.
